Terms of Service ("Terms")

PLEASE READ THESE TERMS OF SERVICE ("TERMS" OR "TERMS OF SERVICE") CAREFULLY BEFORE USING THE WEBSITE AND SERVICES OFFERED BY MYTIFLY PTE. LTD. AND ITS SUBSIDIARIES (COLLECTIVELY REFERRED TO AS "MYTIFLY"). THIS TERMS SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITES AT WWW.MYTIFLY.COM, WWW.MYTIFLY.COM.SG, WWW.KIDIPARTY.COM, WWW.KIDIPARTY.COM.SG AND WEBSITES HOSTED BY MYTIFLY (THE "SITES”) AND SERVICES PROVIDED BY MYTIFLY (COLLECTIVELY, THE “SERVICES”).

By using the Sites in any manner, including but not limited to visiting or browsing the Site, you (the “User" or “You") agree to be bound by this Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. This Terms applies to all users of the Sites, including without limitation users who are vendors, customers, merchants, contributors of content, information and other materials or services on the Site. If you disagree with any part of the terms, then you may not access the Service.

 

1. Mytifly is a Platform

Mytifly acts as a platform to allow users who comply with Mytifly's policies to offer, sell and buy goods. Mytifly is not directly involved in the transaction between buyers and sellers. As a result, Mytifly has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. Mytifly does not pre-screen users or the content or information provided by users. Mytifly cannot ensure that a buyer or seller will actually complete a transaction.

Consequently, Mytifly does not transfer legal ownership of items from the seller to the buyer.

Mytifly cannot guarantee the true identity, age, or nationality of a user. Mytifly encourages you to communicate directly with potential transaction partners via the tools available on the Sites. You may also want to consider using a third-party escrow service or services that provide additional user verification.

You agree that Mytifly is a platform and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on Mytifly. You use the Mytifly service at your own risk.

 

2. Membership Eligibility

Age: Mytifly's services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. You represent and warrant that you are at least 18 years old and that all registration information you submit is accurate and truthful. Mytifly may, in its sole discretion, refuse to offer access to or use of the Sites to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Sites is revoked in such jurisdictions.

Individuals under the age of 18 must at all times use Mytifly's services only in conjunction with and under the supervision of a parent or legal guardian who is at least 18 years of age. In this all cases, the adult is the user and is responsible for any and all activities.

Compliance: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes. In addition, you must abide by Mytifly's policies as stated in the Terms and the Mytifly policy documents listed below (if applicable to your activities on or use of the Site) as well as all other operating rules, policies and procedures that may be published from time to time on the Site by Mytifly, each of which is incorporated herein by reference and each of which may be updated by Mytifly from time to time without notice to you:

In addition, some services offered through the Sites may be subject to additional terms and conditions promulgated by Mytifly from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into this Terms by this reference.

Password: You are responsible for keeping your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree not to provide your username and password information in combination to any other party other than Mytifly without Mytifly's express written permission. You agree to immediately notify Mytifly of any unauthorized use of your password or any breach of security. You also agree that Mytifly cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.

Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address. In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm Account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government issued photo ID, etc.

Account Transfer: You may not transfer or sell your Mytifly account and User ID to another party. If you are signing up for the Service on behalf of your employer, your employer shall be the Account Owner. If you are signing up for the Service on behalf of your employer, then you represent and warrant that you have the authority to bind your employer to our Terms of Service.

Right to Refuse Service: Mytifly's services are not available to temporarily or indefinitely suspended Mytifly members. Mytifly reserves the right, in Mytifly's sole discretion, to cancel unconfirmed or inactive accounts. Mytifly reserves the right to refuse service to anyone, for any reason, at any time.

 

3. Fees and Services

Mytifly does not charge any fee for joining as a buyer (a.k.a. “Mytiflyer”), setting up an account, browsing and buying the Sites. Mytifly reserves the right to change its Fee Policy from time to time. In particular, Mytifly may at its sole discretion introduce new services and modify some or all of the existing services offered on the Sites. In such an event, Mytifly reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Sites and such changes shall automatically become effective immediately after they are posted on the Sites. Unless otherwise stated, all fees shall be quoted in Singapore Dollars. You shall be solely responsible for compliance of all applicable laws including those in Singapore for making payments to Mytifly.

 

4. Listing and Selling

Listing Description: By listing an item on the Sites you warrant that you and all aspects of the item comply with Mytifly's published policies. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale in your Mytifly profile. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category. Each listing must accurately and completely describe the item/items for sale in that listing. Each unique item must have its own listing.

Binding Sale: All sales are binding. The seller is obligated to ship the order or otherwise complete the transaction with the buyer (a.k.a. “Mytiflyer”) in a prompt manner, unless there is an exceptional circumstance, such as:

1. the buyer fails to meet the terms of the seller's listing (such as payment method), or
2. the seller cannot authenticate the buyer's identity. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance.

Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the items. Sellers may not charge excessive shipping fees or otherwise avoid fees. You may not alter the item's price after a sale, misrepresent the item's location and price or use another user's account without permission.

 

5. Prohibited, Questionable and Infringing Items and Activities

You are solely responsible for your conduct and activities on and regarding to Mytifly and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links (together, "Content") that you submit, post, and display on Mytifly.

Restricted Activities:

Your Content and your use of Mytifly shall not:

• Be false, inaccurate or misleading;
• Be fraudulent or involve the sale of illegal, counterfeit or stolen items;
• Infringe upon any third-party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy;
• Violate this Terms, any site policy or community guidelines, or any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• Contain items that have been identified by the Singapore Consumer Product Safety Regulations as hazardous to consumers and therefore subject to a recall;
• Be defamatory, trade libellous, unlawfully threatening, unlawfully harassing, impersonate or intimidate any person (including Mytifly staff or other users), or falsely state or otherwise misrepresent your affiliation with any person, through for example, the use of similar email address, nicknames, or creation of false account(s) or any other method or device;
• Be obscene or contain child pornography;
• Contain or transmit any code of a destructive nature that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
• Host images not part of a listing;
• Take any actions that may undermine or discredit Mytifly;
• Attempt to decompile, reverse engineer, disassemble or hack the Services or Sites (or any portion thereof), or to defeat or overcome any encryption technology or security measures implemented by Mytifly with respect to the Services and/or data transmitted, processed or stored by Mytifly;
• Harvest or collect any information about or regarding other Mytifly account holders, whether through automated means, such as harvesting bots, spiders, robots or scrapers (“Automated Data Collection”), or otherwise, including, without limitation, any personal data or information;
• Upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other unauthorised form of solicitation;
• Modify, adapt or hack Mytifly or modify another website so as to falsely imply that it is associated with Mytifly;
• Take any action or engage in any conduct that could directly or indirectly damage, disable, overburden, or impair the Services or the servers or networks connected to the Services;
• Appear to create liability for Mytifly or cause Mytifly to lose (in whole or in part) the services of Mytifly's ISPs or other suppliers;
• Use the Services to intentionally or unintentionally violate any applicable local, state, national or international law, rule, code, directive, guideline, policy or regulation including, without limitation, laws and requirements (whether or not having the force of law) relating to anti-money laundering or counter-terrorism;
• Use the Services in violation of or to circumvent any sanctions or embargo administered or enforced by the U.S. Department of Treasury’s Office of Foreign Assets Control, the United National Security Council, the European Union or Her Majesty’s Treasury;
• Use the Services to violate the privacy of others or to “stalk” or otherwise harass another;
• Use the Services to collect or store personal data about other Users in connection with the prohibited conduct and activities set forth above;
• Link directly or indirectly, reference or contain descriptions of goods or services that are prohibited under this Terms, the Privacy Policy, or other policy documents as posted on Mytifly.

Furthermore, you may not list any item on Mytifly (or consummate any transaction that was initiated using Mytifly's service) that could cause Mytifly to violate any applicable law, statute, ordinance or regulation, or that violates the Terms of Service.

 

6. Content

License: Mytifly does not claim ownership rights in your Content. You grant Mytifly a license solely to enable Mytifly to use any information or Content you supply Mytifly with, so that Mytifly is not violating any rights you might have in that Content. You grant Mytifly a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the Content, in any media now known or not currently known, with respect to your Content. You agree to allow Mytifly to store or re-format your Content on Mytifly and display your Content on Mytifly in any way as Mytifly chooses. Mytifly will only use personal information in accordance with Mytifly's Privacy Policy.

As part of a transaction, you may obtain personal information, including email address, mobile phone number, and address information, from another Mytifly user. Without obtaining prior permission from the other user, this personal information shall only be used for that transaction or for Mytifly-related communications. Mytifly has not granted you a license to use the information for unsolicited commercial messages, or to disseminate such information on any public platform, including Mytifly. Without limiting the foregoing, without express consent from the user, you are not licensed to add any Mytifly user to your email or physical mail list.

Re-Posting Content: By posting Content on Mytifly, it is possible for an outside website or a third party to re-post that Content. You agree to hold Mytifly harmless for any dispute concerning this use. If you choose to display your own Mytifly-hosted image on another website, the image must provide a link back to its listing page on Mytifly.

Idea Submissions: Mytifly considers any unsolicited suggestions, ideas, proposals or other material submitted to it by users via the Site or otherwise (other than the Content and the tangible items sold on the Site by users) (collectively, the "Material") to be non-confidential and non-proprietary, and Mytifly shall not be liable for the disclosure or use of such Material. If, at Mytifly's request, any member sends Material to improve the site (for example to customer support), Mytifly will also consider that Material to be non-confidential and non-proprietary and Mytifly will not be liable for use or disclosure of the Material. Any communication by you to Mytifly is subject to this Terms. You hereby grant and agree to grant Mytifly, under all of your rights in the Material, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully-paid, sub-licensable and transferable right and license to incorporate, use, publish and exploit such Material for any purpose whatsoever, commercial or otherwise, including but not limited to incorporating it in the API, documentation, or any product or service, without compensation or accounting to you and without further recourse by you.

 

7. Information Control

Mytifly does not control the Content provided by users that is made available on Mytifly and, as such, does not guarantee the accuracy, integrity or quality of such Content. You may find some Content to be offensive, harmful, inaccurate, or deceptive. There are also risks of dealing with underage persons or people acting under false pretence.

You acknowledge that Mytifly may or may not pre-screen Content, but that Mytifly and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, delete or move any Content that is available on the Sites. Without limiting the foregoing, Mytifly and its designees shall have the right to remove any Content

1. that violates these Terms of Service;
2. if we receive a complaint from another User;
3. if we receive a notice of intellectual property infringement or other legal instruction for removal; or
4. if such Content is otherwise objectionable. We may also block delivery of a communication (including, without limitation, feedback, postings, messages and/or chats) to or from the Services as part of our effort to protect the Services or our Users, or otherwise enforce the provisions of these Terms and Conditions.

You acknowledge, and consent to and agree that Mytifly may access, preserve and disclose your account information and Content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over Mytifly or in a good faith belief that such access preservation or disclosure is reasonably necessary to:

1. comply with legal process;
2. enforce these Terms of Service;
3. respond to claims that any Content violates the rights of third parties; or
4. protect the rights, property or personal safety of Mytifly, its users and/or the public.

Additionally, there may also be risks dealing with international trade and foreign nationals. By using Mytifly, you agree to accept such risks and that to the maximum extent permitted by applicable law, Mytifly (and Mytifly's officers, directors, agents, subsidiaries, joint ventures, creators and employees), under no circumstances, will be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of, or reliance on, any Content posted, emailed transmitted or otherwise made available on the Sites, or any  acts or omissions of users on Mytifly. Please use caution, common sense, and practice safe buying and selling when using Mytifly.

Other Resources: Mytifly is not responsible for the availability of outside websites or resources linked to or referenced on the Site. Mytifly does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that Mytifly shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.

 

8. Resolution of Disputes and Release

Disputes with Mytifly: In the event a dispute arises between you and Mytifly, please contact Mytifly. Any dispute arising from or relating to the subject matter of this Terms shall be finally settled by arbitration in Singapore, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with the Arbitration Rules and Procedures of JAMS. The prevailing party in any arbitration or other proceeding arising under this Terms shall be entitled to receive reimbursement of its reasonable expenses (including reasonable solicitors' fees, expert witness fees and all other expenses) incurred in connection therewith. Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator. For all purposes of this Terms, the parties consent to exclusive jurisdiction and venue in the courts located in Singapore. Use of the Site is not authorized in any jurisdiction that does not give effect to all provisions of the Terms, including without limitation, this section. You and Mytifly agree that any cause of action arising out of or related to the Site (including, but not limited to, any services provided or made available therein) or this Terms must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.

Disputes with Users or Third Parties: In the event a dispute arises between you and another, Mytifly encourages you to contact the user or third party to resolve the dispute amicably.

Should you be unable to resolve a dispute between you and another arising from a transaction on Mytifly, please contact Mytifly at support@mytifly.com. Mytifly, for the benefit of users, may try to help users resolve disputes. Mytifly does so in Mytifly's sole discretion, and Mytifly has no obligation to resolve disputes between users or between users and outside parties. To the extent that Mytifly attempts to resolve a dispute, Mytifly will do so in good faith based solely on Mytifly's policies. Mytifly will not make judgments regarding legal issues or claims.

Should you have a dispute with one or more users, or an outside party, you release Mytifly (and Mytifly's officers, directors, agents, subsidiaries, joint ventures, creators and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Mytifly encourages users to report user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.

 

9. Mytifly's Intellectual Property

MYTIFLY, and other Mytifly graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of Mytifly in Singapore and/or other countries. Mytifly's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.

 

10. Breach

Without limiting any other remedies, Mytifly may, without notice, delay or immediately remove Content, warn Mytifly's community of a user's actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user's account privileges, terminate a user's account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

Mytifly suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Terms, the Privacy Policy, or other policy documents and community guidelines incorporated herein; Mytifly is unable to verify or authenticate any of your personal information or Content; or Mytifly believes that a user is acting inconsistently with the letter or spirit of Mytifly's policies, has engaged in improper or fraudulent activity in connection with Mytifly or the actions may cause legal liability or financial loss to Mytifly's users or to Mytifly.

 

11. Privacy

Your privacy is very important to us at Mytifly. To better protect your rights, we have provided the Privacy Policy to explain our privacy practices in detail. Please review the Privacy Policy to understand how Mytifly collects and uses the information associated with your Account and/or your use of the Services. By using the Services or providing information on the Site, you consent to Mytifly’s collection, use, disclosure and/or processing of your Content and personal data as described in the Privacy Policy.

Except as provided in Mytifly's Privacy Policy, Mytifly will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent. Mytifly stores and processes Content on computers that are protected by physical as well as technological security.

Users in possession of another user’s personal data through the use of the Services (the “Receiving Party”) hereby agree that, they will

1. comply with all applicable personal data protection laws with respect to any such data;
2. allow the User whose personal data the Receiving Party has collected (the “Disclosing Party”) to remove his or her data so collected from the Receiving Party’s database; and
3. allow the Disclosing Party to review what information has been collected about them by the Receiving Party, in each case of (ii) and (iii) above, in compliance with and where required by applicable laws.

 

12. No Warranty

MYTIFLY, MYTIFLY'S SUBSIDIARIES, OFFICERS, DIRECTORS, CREATORS, EMPLOYEES, AND MYTIFLY'S SUPPLIERS PROVIDE MYTIFLY'S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. MYTIFLY, MYTIFLY'S SUBSIDIARIES, OFFICERS, DIRECTORS, CREATORS, EMPLOYEES AND MYTIFLY'S SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM MYTIFLY SHALL CREATE ANY WARRANTY. YOU ACKNOWLEDGE THAT THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SITE AND/OR THE SERVICES REMAINS WITH YOU TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

 

13. Liability Limit

IN NO EVENT SHALL MYTIFLY, AND (AS APPLICABLE) MYTIFLY'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR MYTIFLY'S SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, MYTIFLY'S SERVICES, OR THIS TERMS, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

YOU ACKNOWLEDGE AND AGREE THAT YOUR ONLY RIGHT WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH THE SERVICES IS TO REQUEST FOR TERMINATION OF YOUR ACCOUNT AND/OR DISCONTINUE ANY USE OF THE SERVICES.

IF, NOTWITHSTANDING THE PREVIOUS SECTIONS, MYTIFLY IS FOUND BY A COURT OF COMPETENT JURISDICTION TO BE LIABLE (INCLUDING FOR GROSS NEGLIGENCE), THEN, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYTIFLY'S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF MYTIFLY'S SUBSIDIARIES, OFFICERS, DIRECTORS, CREATORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IS LIMITED TO $1.

 

14. Indemnity

YOU AGREE TO INDEMNIFY AND HOLD MYTIFLY AND (AS APPLICABLE) MYTIFLY'S PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, CREATORS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE SOLICITORS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS TERMS OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW, RULES, REGULATIONS, OR THE RIGHTS (INCLUDING INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS) OF A THIRD PARTY.

 

15. No Guarantee

Mytifly does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Mytifly's control.

 

16. Legal Compliance; Taxes

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Sites and any Mytifly service and, if applicable, your listing, purchase, solicitation of offers to purchase, and sale of items. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of items you make on the Sites (excluding any taxes on Mytifly's net income).

 

17. Severability

If any provision of this Terms is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Terms shall remain in full force and effect.

 

18. No Agency

You and Mytifly are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Terms.

 

19. Termination

Mytifly may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

20. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

 

21. Notices

Except as explicitly stated otherwise, any notices shall be given by electronic mail to info@mytifly.com (in the case of Mytifly) or, in your case, to the email address you provide to Mytifly (either during the registration process or when your email address changes). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, Mytifly may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to Mytifly. In such case, notice shall be deemed given three days after the date of mailing.

 

22. Changes

Mytifly reserves the right, at our sole discretion, to modify, alter or replace these Terms at any time.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
